1. About Stratos AI
Stratos AI is operated by Deric Won, a sole trader registered in Western Australia, Australia (ABN: 23 644 632 746). These terms govern all services provided by Stratos AI to clients.
2. Services
Stratos AI provides AI automation, AI content and marketing, and AI search visibility (AEO) services to Australian businesses. The scope, deliverables, price, and timeline for each engagement are confirmed in writing (email or proposal document) before work commences.
All services are provided on a best-efforts basis. While we apply 30+ years of business experience and industry-leading AI tools, we do not guarantee specific business outcomes such as revenue growth, lead generation, or search ranking improvements.
3. Pricing and Payment
- All prices are in Australian dollars (AUD) and are exclusive of GST unless stated otherwise
- GST of 10% applies to all services provided to Australian businesses
- Payment terms are as stated in the proposal or invoice — typically 50% upfront for project work and monthly in advance for retainers
- Invoices unpaid after 14 days may incur a late payment fee of 1.5% per month
- Stratos AI reserves the right to suspend work on unpaid accounts
4. Cancellation and Refunds
- One-off projects: The upfront deposit is non-refundable once work has commenced. If Stratos AI cancels an engagement, a pro-rata refund will be provided.
- Monthly retainers: Cancel with 30 days written notice after the minimum commitment period (2 months for content, 1 month for AEO). No refunds for the current billing period.
- Free audit: The free AI Business Audit carries no financial obligation. Either party may cancel the scheduled call with 24 hours notice.
5. Intellectual Property
Upon full payment, all content and deliverables produced by Stratos AI for a client become the property of that client. Stratos AI retains the right to use general methodologies, frameworks, and non-client-specific approaches in other engagements.
Stratos AI retains ownership of any tools, templates, or systems built for internal use during the engagement unless otherwise agreed in writing.
6. Confidentiality
Stratos AI will treat all client business information as confidential and will not disclose it to third parties without consent, except as required by law. Clients agree to keep any proprietary Stratos AI methodologies and frameworks confidential.
7. Limitation of Liability
To the maximum extent permitted by Australian law, Stratos AI's total liability for any claim arising from our services is limited to the fees paid for the specific engagement giving rise to the claim. Stratos AI is not liable for indirect, consequential, or incidental losses.
Nothing in these terms limits liability for fraud, personal injury, or any matter that cannot be excluded by law under the Australian Consumer Law.
8. AI-Generated Content
Stratos AI uses artificial intelligence tools including Claude (Anthropic) to assist in content production. All AI-generated content is reviewed by our team before delivery. The client is responsible for reviewing all content before publishing or using it in any business context. Stratos AI is not liable for errors in AI-generated content that are not identified during our review process.
9. Governing Law
These Terms & Conditions are governed by the laws of Western Australia and the Commonwealth of Australia. Any disputes will be subject to the jurisdiction of the courts of Western Australia.
10. Changes to These Terms
Stratos AI may update these Terms & Conditions from time to time. The current version is always available at stratosai.com.au/terms.html. Continued engagement with our services after any update constitutes acceptance of the revised terms.
